• Stores your letter for 90 days for retrieval via confirmation code
• Delivers a confirmation email with your letter access code

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

4. Permitted Use

You may use this Service to generate defense letters for traffic citations issued to you personally in the State of Hawaii. You agree to:

• Provide accurate and truthful information when completing the defense letter form
• Use the generated letter only for lawful purposes
• Review the generated letter before submitting it to any court
• Take full responsibility for the content you submit to any court

5. Prohibited Use

You may not use this Service to:

• Generate defense letters for DUI, OVI, DWAI, or any impaired driving offense
• Generate defense letters for hit-and-run, fleeing police, vehicular assault, or vehicular manslaughter
• Submit false, fraudulent, or misleading information to any court
• Generate letters on behalf of another person without their knowledge and consent
• Resell, redistribute, or commercially exploit the generated documents
• Attempt to reverse engineer, copy, or reproduce our letter generation system

We reserve the right to refuse service to anyone at our discretion.

The information provided on this website and the documents generated by our service are for informational and document preparation purposes only. Nothing on this website or in any generated document constitutes:

8. Payment and Refund Policy

Payment

The fee for our Service is $25.00 USD per defense letter, payable at the time of purchase via Stripe. All sales are in US dollars.

Refund Policy

Because our Service delivers a digital product (your defense letter) immediately upon payment, we generally do not offer refunds once the letter has been generated and delivered. However, we will issue a full refund in the following circumstances:

• The Service failed to generate or deliver your letter due to a technical error on our end
• You contact us within 24 hours of purchase and your letter has not been accessed or downloaded
• Duplicate charges due to payment processing errors

To request a refund, contact HITicketDefense@gmail.com with your confirmation code and the reason for your request. We aim to process all refund requests within 3 business days.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We retain your data for 90 days then automatically delete it
• We do not sell your personal information
• You may request deletion of your data at any time

10. Intellectual Property

The Hawaii Ticket Defense website, brand, logo, and underlying technology are owned by us and protected by applicable intellectual property laws. The defense letter generated for you is yours to use for your personal legal matter. You may not reproduce, distribute, or commercialize our service, technology, or content.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Hawaii Ticket Defense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or any damages resulting from:

• Your use or inability to use the Service
• Any outcome of a traffic citation proceeding
• Errors or inaccuracies in the generated letter
• Reliance on information provided through the Service

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for the Service ($25.00).

12. Indemnification

You agree to indemnify and hold harmless Hawaii Ticket Defense and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any false or misleading information you submit through the Service or to any court.

13. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the State of Hawaii.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
